1. Scope

The following General Terms and Conditions (GTC) apply to all orders placed through our online shop. Our online shop is exclusively aimed at consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity. An entrepreneur is a natural or legal person or a legal partnership that acts in the exercise of their commercial or independent professional activity when concluding a legal transaction.

2. Contracting party, conclusion of contract

The purchase contract is concluded with Tinkalu GmbH.

The presentation of products in the online shop does not constitute a legally binding offer, but an non-binding online catalog. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained for this purpose during the ordering process. By clicking the order button, you place a binding order for the goods contained in the shopping cart. Confirmation of receipt of your order will be sent by e-mail immediately after the order has been placed.
When the contract with us is concluded depends on the payment method you have chosen:

Invoice
We accept your order by sending an acceptance declaration in a separate e-mail or by delivering the goods within two days.

Credit card
By placing the order, you simultaneously transmit your credit card data to us. After your legitimation as a legitimate cardholder, we request your credit card company to initiate the payment transaction and thereby accept your offer.

PayPal
During the ordering process, you will be redirected to the website of the online provider PayPal. There you can enter your payment details and confirm the payment instruction to PayPal. After placing the order in the shop, we request PayPal to initiate the payment transaction and thereby accept your offer.

Sofort by Klarna
After placing the order, you will be redirected to the website of the online provider Sofort GmbH, where you confirm the payment instruction. This concludes the contract with us.

3. Contract language, contract text storage
The language available for concluding the contract is German.
We save the contract text and send you the order data and our GTC in text form. You can view the order data in our customer login area if you have registered an account.

4. Delivery conditions

In addition to the stated product prices, shipping costs are added. You can find more information about the amount of shipping costs in the offers.
We only deliver by shipping. Unfortunately, self-collection of the goods is not possible.
We do not deliver to packing stations.

5. Payment

The following payment methods are generally available to you in our shop:

Credit card
By placing the order, you simultaneously transmit your credit card data to us.
After your legitimation as a legitimate cardholder, we request your credit card company to initiate the payment transaction immediately after the order. The payment transaction is automatically carried out by the credit card company and your card is debited.

PayPal
During the ordering process, you will be redirected to the website of the online provider PayPal. To be able to pay the invoice amount via PayPal, you must be registered there or register first, legitimize yourself with your access data and confirm the payment instruction to us. After placing the order in the shop, we request PayPal to initiate the payment transaction. 
The payment transaction is automatically carried out by PayPal immediately thereafter. Further information can be found during the ordering process.

Sofort by Klarna
After placing the order, you will be redirected to the website of the online provider Sofort GmbH. To be able to pay the invoice amount via Sofort, you must have an online banking account activated for participation in Sofort with PIN/TAN procedure, legitimize yourself accordingly and confirm the payment instruction to us. Further information can be found during the ordering process. The payment transaction is carried out by Sofort immediately thereafter and your account is debited.

Invoice
You pay the invoice amount after receiving the goods and the invoice by bank transfer to our bank account. We reserve the right to offer purchase on account only after a successful credit check.

6. Retention of title

The goods remain our property until full payment.

7. Transport damages

If goods are delivered with obvious transport damage, please report such defects to Tinkalu GmbH immediately by e-mail to tinkalu@tinkalu.com. Failure to make a complaint or contact has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, you help us to assert our own claims against the carrier or transport insurance.

8. Warranty and guarantees

The statutory liability for defects applies. Information on any applicable additional guarantees and their exact conditions can be found with the product and on special information pages in the online shop.

9. Liability

For claims due to damages caused by us, our legal representatives or vicarious agents, we are always liable without limitation

for injury to life, body or health,
for intentional or grossly negligent breach of duty,
for guarantee promises, if agreed, or
if the scope of the Product Liability Act is opened.

In the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the contracting party may regularly rely (cardinal obligations) due to slight negligence on our part, our legal representatives or vicarious agents, liability is limited in amount to the foreseeable damage typical for the contract at the time of conclusion of the contract. Otherwise, claims for damages are excluded.

10. Dispute resolution
The European Commission provides a platform for online dispute resolution (OS), which you can find here https://ec.europa.eu/consumers/odr/. 
We are prepared to participate in an out-of-court conciliation procedure before a consumer arbitration board.
